Terms and Conditions

 

 

1. Definitions

“EnergyTus” means the privacy notice located at https://energytus.com/privacy-policy/ (and any successor or related site designated by us), as may be updated from time to time.

“EnergyTus” means https://energytus.com/ (and any successor or related site designated by us), as may be updated from time to time.

“Event Sponsor” means a third-party sponsor of the Event.

“Hybrid or Virtual Event” means an Event that has an in-person aspect and a virtual aspect.

“Your Materials” or “delegates” means all materials submitted (including, for example, your name and biographical information) or presented by you (in electronic copy or hard copy, verbally, or otherwise).

These Event terms govern your purchase of tickets for, and attendance at events held by EnergyTus. It is your responsibility to review these Terms prior to the purchase of tickets. By purchasing tickets you agree to be bound by these Terms. We reserve the right to amend these Terms at any time, and will provide the most recent version on our website.

Throughout these Terms, the terms “EnergyTus”, “we”, “us” and “our” refer to Business EnergyTus and its associated entities, and “you” refers to the individual or business or university purchasing tickets or stands or sponsoring the Event.

2. Name Authority, Patents and Trademarks

2.1 All trademarks, service marks, trade names, slogans, logos, and other indicia of origin that appear at or in connection with the event are the property of EnergyTus and/or its affiliates. Delegates may not copy, display or use any of these marks without prior written permission by the relevant owner. The event and/or portions of the event may be protected under patent law as the subject of issued patents and/or pending patent applications.


3. Promotions and Advertising

3.1 Advertisements or promotional materials from third parties may be presented at the event and on EnergyTus website. Delegates’ participation in any third party promotion is subject to the terms and conditions associated with that promotion, and EnergyTus will not be held responsible for any liable, loss, or damage of any kind incurred as a result.


4. Refunds/Cancellations:

4.1 EnergyTus and venue management reserve the right to refuse admission or to eject delegates in circumstances deemed. Delegates may also be refused entry or ejected from the venue on account of exhibiting anti-social behaviour. No refunds will be offered to delegates who are refused entry or who are ejected in these circumstances.

4.2 If registration fees or other fees are required for the Event, cancellation instructions and the Event’s refun
d policy will be listed on the Event’s registration webpage.

4.3 We may cancel the Event at any time for reasons including, for example, availability or suitability of venue or speakers or on security, health, or safety grounds, and we may deny, limit, or cancel your Event registration at any time. We are not responsible for any damages, direct or indirect, resulting from such cancellation. If we cancel the Event or your registration and you are in compliance with these Terms, we will issue you a refund of your Event registration fee in accordance with the refund policy on the Event’s registration webpage.

4.4 EnergyTus reserves the right to amend or cancel the event. This includes changes to dates, times, speakers, content and the programme.

4.5 In the unlikely occurrence that EnergyTus cancels an event, delegates may be be offered to attend an alternative event held by EnergyTus.

4.6 Alternatively, EnergyTus will not return any payments received in advance. EnergyTus will also not refund any other costs incurred
because of this cancellation.

4.7 All the numbers on visitors, companies, universities etc are an estimation only. EnergyTus shall not be held responsible if the numbers are not met.

4.8 EnergyTus will not be responsible if the promised speakers, companies or universities are not available as mentioned in the websites, brochures and other communication.


5 Cancellations by the delegate

5.1 EnergyTus
event organizers must be notified of cancellations in writing, or by email to internationalexpo@energytus.com


6. Privacy

6.1 Delegate details are managed in accordance with EnergyTus’ data protection and privacy policy. Events managed by EnergyTus on behalf of a third party or affiliate, are subject to delegate information being shared with the third party organisation.

6.2 Photography, filming and recording may be carried out at the venue from time to time. Delegates consent to being included in photographs, video and/or sound recordings which may be used by the College, without payment, in printed and electronic media, including EnergyTus website and social media, for promotion of EnergyTus and its activities and may be selected for permanent preservation in the College archives and used for research, publication, education, lectures, broadcasting, public performance, displays and exhibitions.


7. Force Majeure

7.1 EnergyTus will not be held liable for delay in delivery, or failure to deliver due to any cause outside of EnergyTus reasonable control. In the instance of Force Majeure, delay or failure to deliver will not constitute a breach of contract and the timeframe for delivery by EnergyTus will be extended by a reasonable period.


8. Event

8.1
You may only register and attend the Event in accordance with these Terms. To register for the Event, you must complete the Event registration process and pay any registration fee. Unless the Event’s registration webpage specifies otherwise or we expressly inform you otherwise
. You must be at least 14 years of age on the first day of the event. Event registration is subject to availability and may close earlier than the posted deadline, as determined in our sole discretion.

8.2 We may also change the Event program at any time in our sole discretion. You will at all times comply with our Code of Conduct.

8.3 Every reasonable effort will be made to adhere to the event programme as advertised, however, EnergyTus shall not be responsible for no placements, no new admissions or no networking done by whatsoever means.


9. Alterations to advertised packages

9.1 Every reasonable effort will be made to adhere to the event programme as advertised, however, EnergyTus reserves the right to make changes to any event, including the dates, times, speakers, content, and the programme.

9.2 EnergyTus accepts no contractual liability for any changes made to an event prior to confirmation of the booking.


9.3 Delegates agree to accept changes made to an event by EnergyTus, after confirmation of booking. EnergyTus will make every reasonable effort to ensure any changes are appropriate and relevant.


10. Your Information.

10.1 Sharing with Event Sponsors. We may provide your contact information to Event Sponsors if (a) you elect to attend any sessions or other activities at the Event involving Event Sponsors (in which case we would provide your contact information only to the Event Sponsor involved in such session or other activity,) or (b) you opt in during registration or otherwise to receive communications from our Event Sponsors.

10.2 Voice and Image. By participating in the Event experiences, you agree that we may derive information from recordings of your voice and images
, of your face and retain and use all resulting information.


11. Recordings and Your Materials.

11.1 You grant us, our affiliates, and our independent contractors the right to record, film, photograph, and capture your voice and image in any media at the Event (the “Recordings”). You grant to EnergyTus and its affiliates, agents, employees, and assigns an irrevocable, nonexclusive, perpetual, worldwide, royalty-free right and license to use, reproduce, modify, distribute, and translate, for any purpose relating to our business, all or any part of the Recordings and Your Materials. We may edit the Recordings and Your Materials, use them alone or together with other information, and allow others to use and disseminate them. To the maximum extent permitted by law, you waive any moral rights you may have in the Recordings and Your Materials. You represent and warrant that
(a) Your Materials are true and accurate to the best of your knowledge,
(b) you have the necessary rights and permissions to grant the license and
(c) Your Materials do not violate or infringe any copyright, trademark, or other proprietary rights of any person or entity.


12. Special Provisions for Certain Jurisdictions for Virtual Events.

12.1 Notwithstanding anything to the contrary contained in these Terms:

12.2 India: For any virtual Event that states on its registration website that it is hosted by EnergyTus:

(a) The laws of India, without reference to conflict of law rules, govern these Terms and any dispute of any sort that might arise between the parties. All disputes and differences arising out of these Terms will be referred to arbitration by a sole arbitrator. The decision and award determined by such arbitration will be final and binding upon the parties. The arbitration will be conducted in accordance with the provisions of the (Indian) Arbitration and Conciliation Act, 1996, as may be in force from time to time. The arbitration proceedings will be conducted in English and the seat of the arbitration will be New Delhi.

13. Law and Jurisdiction

13.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of UAE and any disputes shall be subject to the jurisdiction of the courts of UAE, unless otherwise submitted by EnergyTus.
